President Biden, exactly two years after he first made the promise to nominate the first Black woman to the Supreme Court, has made good on that pledge. Biden's decision to nominate Ketanji Brown Jackson is nothing short of historic. If confirmed, not only would she be the first Black woman to serve on the high court, but she'd also be the first public defender in three decades. As my colleague Stephanie Mencimer wrote earlier this month:
Unsurprisingly, Republicans, including Lindsey Graham, who previously voted to confirm Jackson to the DC circuit, are blasting the choice as a concession to the so-called "radical left." They're also absurdly criticizing her Ivy League education. (Hello Brett Kavanaugh! Greetings Neil Gorsuch!) Anyway, the hellscape is relentless these days, so we're bound to see much more of that drivel as the confirmation process heats up. But for now, especially as so much in the world goes intensely dark, let's bask in the excellent choice of Jackson—and get excited about the potential of having a public defender finally back on the Supreme Court. —Inae Oh How a post–Civil War statute is being brushed off to save American democracy.
